Residential Burn Ban Signed Into Law
A Bill that prohibits residents from burning certain household waste items has been signed into law this week by Lt. Gov Calley. House Bill 4207, sponsored by Rep. Kurtz (R-Branch County), was substituted in the Senate this week and the House concurred: the final vote in the House was 87-22.
The Bill was introduced in response to an attempt by the DEQ to disallow all open burning of household waste. The bill amends the Natural Resources and Environmental Protection Act, parts 55 and 115 specifically, to prohibit the burning of plastics, rubber, foam, chemically treated wood, textiles, electronics, chemicals, hazardous materials and any other substance with toxic chemicals.
Residents would still be allowed to burn non-hazardous waste, such as household trash, fruit/vegetable storage crates and yard waste. Finally, the bill prohibits the DEQ from promulgating rules that add to the list of items that cannot be burned. Lt Gov. Calley signed the legislation because Gov. Snyder was visiting Michigan troops in Afghanistan.
